ORDINANCE NO. 2017-18
AN ORDINANCE VACATING A PORTION OF A PUBLIC UTILITY AND DRAINAGE EASEMENT
WHEREAS, the project location is Rachel Drive and North Town Road, there is an adjustment which involves vacating a public utility and drainage easement located behind lots 107 & 108 at Paradise Village @ Zion, and
WHEREAS, the easement is adjacent to the Hamblin Parkway right-of-way and the current width of the easement is 20’ wide. A portion of the easement, approximately 5’ is proposed to be vacated, and
WHEREAS, staff recommends vacating the public utility and drainage easement and the width of the remaining easement will suffice for the utility/drainage easement, and
WHEREAS, the City Council of the City of Santa Clara, after proper legal notice was given, held a public hearing on June 28, 2017 in the City Council Chambers on the proposed easement vacation, and
WHEREAS, the Santa Clara City Council has determined there is good cause for vacating this utility and drainage easement, and
NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Santa Clara, Utah, as follows:
Section 1. Clarification:
This is a non-code Ordinance.
Section 2. General Provisions:
Vacating an existing utility/drainage easement and the easement being more fully described as follow:
“VACATION OF PORTION OF 20 FOOT WIDE UTILITY AND DRAINAGE EASEMENT”
A 5’ ft. portion of easement to be vacated from the 20 foot public utility and drainage easement as recorded as Entry No. 20120004301, more particularly described as follows:
Beginning at a point on the westerly line of Paradise Village at Zion Phase 6, said point being North 00°44’49” East 132.31 feet along said westerly line from the southwest corner of said Paradise Village at Zion Phase 6, and running;
thence North 00°44’49” East 22.33 feet along said westerly line;
thence North 23°42’58” East 95.20 feet;
thence North 11°50’45” East 113.94 feet to the southwesterly line of Snow Canyon KH Subdivision;
thence South 51°46’51” East 6.22 feet along said southwesterly line;
thence Southerly 228.15 feet along an arc of a 726.00 foot radius curve to the right (center bears North 81°53’23” West, long chord bears South 17°06’46” West 227.21 feet with a central angle of 18°00’19”) to the Point of Beginning.
Section 3. Effective Date:
The effective date of this Ordinance shall become effective immediately upon adoption and posting in the manner required by law.
ADOPTED and Order posted by a duly constituted quorum of the City Council of the City of Santa Clara, Utah, this 12th day of July, 2017.
