CITY OF SANTA CLARA, UTAH
ORDINANCE NO. 2017-10
AN ORDINANCE TO AMEND THE MUNICIPAL CODE OF THE CITY OF SANTA CLARA UTAH BY AMENDING TITLE 17, SECTION 17.32, “OFF STREET PARKING REQUIREMENTS” AND ESTABLISHING AN EFFECTIVE DATE.
WHEREAS, it is important to update the City’s code from time to time to remain relevant and reflective of the ever-changing operating environment of the City; and
WHEREAS, staff would like to amend Title 17, Section 17.32.030, “Access to individual parking spaces” to increase the setback from the garage or carport to the private street from 18’ to 20’, and
WHEREAS, pursuant to said requirements of Santa Clara Municipal Code and UCA 10-9a-205 the Planning Commission conducted a properly advertised public hearing on the amendment to the City’s Code on April 11, 2017; and
WHEREAS, in accordance with the requirements of the UCA 10-9a-302, the Planning Commission of Santa Clara City forwarded its recommendation to the City Council as of April 26, 2017 regarding proposed changes to Title 17, Section 17.32.030, “Access to individual parking spaces”; and
WHEREAS, the legislative body of the City of Santa Clara reviewed the recommendation of the Planning Commission and acted on the proposed amendment to Title 17 Section 17.32.030, “Access to individual parking spaces” and
NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Santa Clara, Utah, that Title 17, Section 17.32.030 “Access to individual parking spaces” be amended as follows.
Section 1. Amendment:
17.32.030: ACCESS TO INDIVIDUAL PARKING SPACES:
C. On private streets or access drives, a garage or carport shall be set back a minimum of twenty (20) feet from the back of the sidewalk, or where no sidewalk exists or is planned, from the curb, or lot boundary line.
Section 2. Effective Date:
This Ordinance shall become effective immediately upon adoption, recording and posting in the manner prescribed by law.
